RELEASE OF LIABILITY, WAIVER OF CLAIMS, AND ASSUMPTION OF RISK AGREEMENT**
By attending or participating in the Earth Vibe Festival (“Event”) hosted by Aligned in Light LLC on private property (“Premises”), I acknowledge and agree as follows:
1. ASSUMPTION OF RISK
I understand that attendance at a rural, outdoor festival involves inherent and significant risks, including but not limited to: serious bodily injury, illness, permanent disability, property damage, or death. These risks include, but are not limited to:
Open and unguarded bodies of water, with risk of drowning
Old or partially deteriorated structures, including a barn, with potential structural hazards
Uneven ground, holes, mud, rocks, and natural obstacles
Wild or domestic animals, insects, and plants
Weather conditions including heat, cold, storms, and lightning
Food-related illness or allergic reactions
Participation in physical activities, workshops, performances, or use of equipment
Actions or negligence of other attendees, staff, vendors, or third parties
I voluntarily and knowingly assume all such risks, whether known or unknown.
2. RELEASE AND WAIVER OF LIABILITY (INCLUDING NEGLIGENCE)
To the fullest extent permitted by law, I hereby release, waive, and discharge Aligned in Light LLC, the property owners, organizers, employees, volunteers, vendors, sponsors, and all affiliated parties (collectively, “Released Parties”) from any and all claims, demands, or causes of action arising out of or related to any injury, illness, damage, or loss, including death, that I may suffer arising from or related to my presence at or participation in the Event, INCLUDING ANY CLAIMS ARISING FROM THE NEGLIGENCE OF THE RELEASED PARTIES.
3. AGREEMENT TO FOLLOW RULES AND SAFETY INSTRUCTIONS
I agree to follow all posted rules, signage, and instructions from event staff. I understand that failure to do so may increase risk of injury and may result in removal from the Event without refund.
4. INDEMNIFICATION AND HOLD HARMLESS
I agree to indemnify, defend, and hold harmless the Released Parties from any claims, liabilities, damages, costs, or expenses (including attorney fees) arising out of or related to my actions, omissions, or participation in the Event.
5. MEDICAL RESPONSIBILITY AND EMERGENCY CARE
I understand that medical services may be limited due to the rural location. I assume full responsibility for any medical costs incurred. In the event of an emergency, I authorize the Event organizers to obtain medical treatment on my behalf if I am unable to do so, and I agree to be financially responsible for such care.
6. INSURANCE
I acknowledge that I am responsible for maintaining my own health, accident, and property insurance.
7. MINORS
If I am signing on behalf of a minor, I certify that I am the minor’s parent or legal guardian and agree to all terms on their behalf. I further agree to indemnify the Released Parties against any claims brought by or on behalf of the minor.
8. SEVERABILITY
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
9. GOVERNING LAW AND VENUE
This Agreement shall be governed by the laws of the State of Wisconsin, and any legal action shall be brought exclusively in the appropriate courts within the state.
10. ACKNOWLEDGMENT OF UNDERSTANDING
I HAVE READ THIS AGREEMENT CAREFULLY AND FULLY UNDERSTAND THAT I AM WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. I SIGN THIS AGREEMENT FREELY AND VOLUNTARILY.
